A process server is a trained professional who serves legal documents to defendants who are named in a court proceeding.
Our Process servers provide proper documentation that complies with local laws and keep proper records of their service of process that would be admissible in court should the need ever arise.
Process servers are trained to find individuals and ensure that they are given notice of a legal action
that is being taken against them.
Proper service of process is required before a legal proceeding can get underway.
Whether the person who is served decides to avail themselves of legal counsel or
not following service of process is of no concern.
Merely being put on notice is enough.
A defendant ignores the serving of legal documents at their own peril.
Prepare the Documents:
You will need to provide your server with:
- A copy of the forms you are filing (such as a Summons, Complaint, or Request for Order). Email forms.
- A blank copy of the correct Proof of Service form (e.g., Proof of Personal Service FL-330 for family law or POS-040 for general civil).
Complete the Service and File:
After handing the documents to the opposing party, your server must fill out, date, and sign the Proof of Service form.
You must then file this signed form with the local Monterey County Superior Court to prove to the judge that the other party was legally notified.
